Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the SendMailOS website and service operated by SendMailOS Inc.

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.
2. Description of Service
SendMailOS provides an email marketing platform that enables users to create, send, and manage email campaigns, automate email workflows, manage subscriber lists, and analyze email performance metrics.
3. Accounts
When you create an account with us, you must provide us information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.
You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. You agree not to disclose your password to any third party.
4. Acceptable Use
You agree not to use the Service to:
- Send unsolicited bulk email (spam)
- Send emails to purchased, rented, or scraped lists
- Violate any applicable laws or regulations
- Infringe on the intellectual property rights of others
- Transmit any malicious code or harmful content
- Interfere with or disrupt the Service
We strictly enforce our Anti-Spam Policy.
5. Subscription and Payment
Some parts of the Service are billed on a subscription basis. You will be billed in advance on a recurring basis (monthly or annually), depending on the subscription plan you select.
At the end of each billing period, your subscription will automatically renew unless you cancel it or we terminate it. You may cancel your subscription at any time through your account settings.
6. Intellectual Property
The Service and its original content, features and functionality are and will remain the exclusive property of SendMailOS Inc. and its licensors. The Service is protected by copyright, trademark, and other laws.
You retain all rights to the content you upload to the Service, including your email templates and subscriber lists.
7. Data Protection
We process personal data in accordance with our Privacy Policy. By using the Service, you agree to the collection and use of information as described therein.
8. Limitation of Liability
In no event shall SendMailOS Inc., nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses.
9. Termination
We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
Upon termination, your right to use the Service will cease immediately. If you wish to terminate your account, you may simply discontinue using the Service or contact us.
10. Changes
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days notice prior to any new terms taking effect.
11. Governing Law
These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
